1. Scope of Application

These Terms and Conditions govern the purchase of products and services conducted remotely via Internet from the website managed by the YOUR HOME STYLING COSTA DEL SOL S.L. The Terms and Conditions of sale shall apply to all deliveries effected by YOUR HOME STYLING COSTA DEL SOL S.L. or on behalf of its website www.yourhomestyling.es

2. Acceptance of the Terms and Conditions of Sale

By e-mail confirming the purchase order, the Customer unconditionally accepts the general conditions and payment terms, undertakes to abide by them in their dealings with the virtual shop, declares that they have read, and agreed to, all the terms of the regulations.

The sale and delivery of products by YOUR HOME STYLING COSTA DEL SOL S.L. and its divisions, subsidiaries and affiliated companies are subject to these terms and conditions. The agreement between the Customer and YOUR HOME STYLING COSTA DEL SOL S.L., governed by these Conditions, shall be described as the ‘Agreement’, without giving effect to any other conditions that may be contained in any order form, document or other communication that would modify, alter, or infringe the terms of this Agreement.

3. The Customer’s Obligations

Customers visiting this site and the virtual shop should read the ONLINE Terms and Conditions of Sale before confirming their purchases. The sending of the order confirmation therefore implies a complete knowledge and acceptance of these Terms and Conditions of Sale. To comply fully with Spanish Law, the Customer agrees that, once the on-line purchase process has been completed, they will print and keep these Terms and Conditions of Sale, having previously read and accepted them during the purchasing process.

The Customer shall be solely liable for and shall exonerate YOUR HOME STYLING COSTA DEL SOL S.L. from, any harm resulting from the improper use, storage, holding or handling of the Products, particularly when the relevant indications, warning or instructions provided by YOUR HOME STYLING COSTA DEL SOL S.L. have not been observed.

Any information about the Products is provided by YOUR HOME STYLING COSTA DEL SOL S.L., without YOUR HOME STYLING COSTA DEL SOL S.L. assuming any responsibility or offering any guarantee for the same. YOUR HOME STYLING COSTA DEL SOL S.L. makes no statements and issues no guarantees as to the accuracy or completeness of the Product information and does not accept any liability with respect to any product information.

4. Placing and Order in the Virtual Shop

The Customer purchases the products available as described ONLINE in the relevant descriptive and technical specifications. Before confirming the purchase, the Customer will see a summary including the unit cost of each pre-selected product and the total cost when purchasing more than one product. On confirming the purchase, and upon completion of the transaction, the Customer will receive a confirmation of the order including the Number, Date and Total Cost of their Order by email. If you notice any errors on the confirmation, please communicate it by email to info@yourhomestyling.es.

5. Payments

The products will be paid for by credit card or debit card if they are implemented on the website, operational and accessible. Similarly, the online shop guarantees that the European law will be complied with in respect of the security measures that are necessary when providing banking data.

6. Availability and Delivery of Products

Our warehouse is the place to which all orders are delivered and from there distributed to the Customer. The products purchased by the Customer will be delivered within 2 to 10 weeks from the date the payment is made. Deadlines for deliveries are approximate, and no claims for damages are envisaged in case of delay.

7. Transport

The Products are sent with carriage paid and charged on the purchase invoice. Transport costs will vary and will depend on weight, volume and city.

The Customer is not entitled to indicate the means of transport by which they wish to receive the Products, which will be sent by whatever means the YOUR HOME STYLING COSTA DEL SOL S.L. considers appropriate.

YOUR HOME STYLING COSTA DEL SOL S.L. online store sells to Spain and does not currently ship to other countries.

Transport is free of charge when order amount exceeds 500 EUR in Malaga Province.

8. What To Do When Receiving Your Consignment

Verify that the Product is what you have ordered and that it is free of apparent damage. If everything is in order, accept the delivery.

If the Product is not what you ordered, or if it appears to have external damage, then refuse the delivery after indicating the problem.

Send an e-mail to info@yourhomestyling.es within the following two business days, with a description of the problem.

9. Prices

The published prices are valid except in cases of typographical errors or lack of stock. The prices shown are in Euros and have the VAT INCLUDED for the European Union.

YOUR HOME STYLING COSTA DEL SOL S.L. reserves the right to modify the sale price of the Products at any time. A price increase will not affect orders in progress that have been previously accepted by YOUR HOME STYLING COSTA DEL SOL S.L.

Customers whose countries of residence operate in a currency other than the Euro should be aware that the financial institutions who are in charge of the means of payment and authorized by the online shop always take the equivalence for payment. If for reasons outside YOUR HOME STYLING COSTA DEL SOL S.L.’s control this does not happen, and there is an exchange difference, YOUR HOME STYLING COSTA DEL SOL S.L. will warn the Customer, because the order will not be taken into account until payment is totally settled in Euros.

10. Treatment of Personal Data

In accordance with the current legislation governing the protection of personal data, the online shop informs the User of the existence of an automated file of personal data of the users (Customers) who enter their data into the Corporate Website, which has been created for the purpose of carrying out tasks of information, training and promotion of the services of the online shop.

The online shop also informs you of the possibility of exercising your rights of access to, rectification of, cancellation of, and opposition to the personal data included in the said file. The online shop is committed to fulfilling its obligation to keep personal details secret and will take the measures that are necessary to avoid their alteration, loss, unauthorized processing, or access, at all times taking into account the current state of technology.

11. Warranties

YOUR HOME STYLING COSTA DEL SOL S.L. guarantees the quality and reliability of the Products. Such warranty is not effective when the goods are modified, altered or dismantled, because the Customer is responsible for any modification.

YOUR HOME STYLING COSTA DEL SOL S.L. offers a 2-year warranty.

12. Final Clarification

To the extent permitted under the applicable law, neither YOUR HOME STYLING COSTA DEL SOL S.L. nor its employees shall be liable, and the Customer shall not be entitled to claim, for any indirect, special, occasional, or consequential damage, nor for any emerging damage or loss of profit that could occur.

To the extent permitted under the applicable law, and only in the event of direct damage being caused, YOUR HOME STYLING COSTA DEL SOL S.L shall compensate the Customer with an amount that will never exceed the original price of the Product in question.
